ED is again directed to appeal to the Single Bench of the High Court
ED challenges bail of Babulal Verma, Kamal Gupta
Mumbai : The Enforcement Directorate (ED) has challenged in the Bombay High Court the interim bail granted by a special PMLA court to Omkar Group director Babulal Verma and chairman Kamal Gupta, who are in custody under PMLA.
However, the court refused to hear it on Thursday and directed to appeal to the appropriate single bench of the High Court.
ED had arrested Omkar Group Managing Director Babulal Verma and Chairman Kamal Gupta 18 months ago in connection with a financial misappropriation of around Rs 22 thousand crores.
During the hearing on it, the judge of the special court. MG Deshpande granted bail. That bail was challenged by the ED in the High Court on Wednesday. However, the court refused to interfere with that decision.
Subsequently, the ED has filed a petition against the plea of acquittal made by Babulal Verma and Kamal Gupta in the case against the order passed by the special court on August 8. Take that application on Thursday. The hearing was held before Prakash Naik. Then, the ED's application was opposed by Verma and Gupta.
On Wednesday, a single bench of the High Court rejected the application of the ED and it is claimed that the ED has made a new application by changing the form of the same application. By Vijay Agarwal.
On the other hand, if the Special Judge considers that he has no jurisdiction in the matter, he cannot make any order regarding the custody of the accused. Therefore, the Special Court should quash the observations made in the order regarding its jurisdiction and direct a fresh hearing. Such an argument on behalf of ED. Hiten Venegaonkar did.
However, the court refused to accept the ED's argument. In view of the mention of bond and guarantor by the special court in the order, the said court is not competent to hear the matter and directed the ED to appeal to the appropriate single bench.
