The Madras High Court has directed the Central Government to release the parrot of Central Bureau of Investigation (CBI) from government cages and give it constitutional autonomy like the CAG so that it would work more efficiently.
The court has directed the Center to take a decision within a month on the restructuring of the CBI in the wake of opposition to the demand for transfer of Rs 300 crore financial investment scam case to CBI due to lack of manpower. Justice N Kirubkaran and Justice. B. Pugalendhi's bench said the order was part of an effort to free the caged parrot. The order said that the director of the CBI should be given the status of Union Secretaries, the CBI should be directly accountable to the Prime Minister and Parliament, the institution should be given more facilities and a separate provision should be made in the budget for the same.
Opposition always alleges that the CBI has become a pawn in the hands of the ruling Bharatiya Janata Party (BJP) and is being used by the ruling party to achieve political ends. In particular, Trinamool Congress' leader and West Bengal Chief Minister Mamata Banerjee have dubbed the organization the 'Conspiracy Bureau of Investigation controlled by the Prime Minister'.
The CBI was established in 1941. The CBI is currently working under the Personnel and Training Department under the control of the Prime Minister's Office. The directors of the CBI are appointed by the Prime Minister, the Chief Justice of the country and the Leader of the Opposition. The Madras High Court has said that the CBI should be empowered to set up quality investigative mechanisms such as the FBI in the US and Scotland Yard in the UK.
